Functions of right actuated as an effect of an injury received or feared

1640. The functions of right actuated as a result of an injury already received, or even begun, or at least feared, are reduced to two: 1. defence, which includes the right of prevention and a right to guarantees, and 2. satisfaction. These functions are normally called right by authors who speak of the right of defence, of satisfaction, or guarantee, and so on. We shall discuss each of them, but first lay as the foundation of our treatise certain principles concerning the inviolability of all rights in general. In this way, we shall continue to clarify the concept of the Right of ownership under its negative form as the Right not to be harmed.(481)

(481) The right not to be harmed can be analysed in various ways. For example, one of the lesser rights contained in that of not being harmed could be expressed as follows: `The right to have the harm prevented at every moment.' Other examples of these lesser, elementary rights will be mentioned in the course of the treatise.
